Plaintiff was injured when he fell in the parking lot of his apartment complex. The parking lot was covered with snow and ice and Plaintiff alleged that the complex knew the condition was unsafe and failed to fulfill its duty to maintain the parking lot in a safe condition.

Plaintiff first sought treatment at the emergency room the day after his fall and was diagnosed with a contusion to his elbow, prescribed a sling and discharged from the hospital. About ten (10) days later, after Plaintiff’s elbow failed to improve, he sought treatment from an orthopedic surgeon and was diagnosed with a non-displaced radial head fracture and prescribed rest and physical therapy. His medical bills totaled approximately $5,000.00. After filing suit, W. Morris Taylor, P.C. secured a settlement for $35,000.00.
