Personal Injury: Oil Refinery

Parties: Plaintiff: Factory worker; Defendant: Large oil refinery
Jurisdiction:United States District Court - Confidential
Amount of Settlement: $3,250,000.00

W. Morris Taylor (St. Louis) for Plaintiff who was injured by a piece of industrial equipment while performing his job duties for a chemical company. A product liability suit could not be filed and injury attorney Taylor theorized that a manufacturer negligence cause of action was in order because Plaintiff's injuries resulted from an unguarded, rotating shaft which had been modified by the Plaintiff's employer, leaving a raised rotating set screw. The unguarded set screw caused Plaintiff's clothing and right hand to be entrapped in the machine, causing evulsion, fracture and crushing of part of Plaintiff's right hand.

Plaintiff suffered from the evulsion injury to his right hand (dominant) and suffered from reflex sympathetic dystrophy and depression.

Settlement on first day of trial $3,250,000.00.
